PHILIP NARDUCCI, OFFICALLY CHANGES PLEA, BREAKING NEWS!!
Philip Narducci has officially changed his plea in court. For those that have been following the case, you all know how vocal I was about this case. You also know I dropped information and proof that the informant in this case was highly unreputable, and full of shit. You also know I made arguments as to why sometimes one has to accept a plea. It's the lesser of two evils in this situation for Phil.
Phil changed his plea to guilty as stated earlier and the judge overseeing the case has accepted his change of plea. The deal the Government arranged calls for a one year and one day sentence to which Phil agreed to. Phil also asked the Judge presiding in the case to remand him as of 8am Monday morning to begin serving his sentence, which isn't known because the Judge will announce the sentence September 10th, 2019. It's more or less not going to change the bottom line for Phil as far as the time he has to serve. With good time, and with having to serve 85% of your time at the federal level, Phil is looking at between 7-8 months, which is why he remanded himself to begin with.
"Jeff I just wanna get this shit done. I wanna get these three months out of the way, who wants to sit at home with a monitor on their ankle, while they fucking shit?" is exactly what he told me when he called me after his hearing. He was in good spirits, agitated a bit by having to accept a plea deal, but he said "You know I didn't want to do it, but I had to. I didn't wanna roll the dice, Jeff, it's kills me to do this."
This happens to a lot of guys. I mean if Phil rolled the dice, maybe he wins, maybe he doesn't. If he wins, great, but if he loses, that's 20 plus years, and at his age, that could very well be a life sentence, and that's a risk not many would take. Keep in mind the evidence was on Phil's side completely, believe me when I tell you that, but once again we have a system in place, where the government can spend a blank check as many times as they want, and keep in mind paying for a defense attorney is no joke. If the Feds can't beat you they'll bankrupt you.
Phil did the right thing in the end, for himself, his business, and most importantly his family. You sometimes have to take it on the chin, even when you didn't do what the government is saying you did. The one thing people will argue is, why accept a plea if you didn't do it? Simple argument for you all who are saying it. A few months or 40 years? Bankrupt or comfortable? The government doesn't ever budge when they have a slam dunk, they don't do anybody any favors. Keep that in mind. We will miss Phil, but only for a few months.
